Chapitre I — Dénomination, siège, objectifs, composition

Article 1. La Société Tunisienne de Pédiatrie (STP) a été fondée en 1960 conformément aux dispositions de la loi 154/1959 du 07/11/1959, telle que modifiée par la loi organique n°90/1988 du 02/08/1988 et par la loi n°25/1992 du 02/04/1992. Elle est devenue Association Tunisienne de Pédiatrie (ATP) le 8 septembre 1998, conformément à la nouvelle loi sur les associations. Son siège est à l'hôpital Béchir Hamza à Tunis. C'est une association scientifique régie par les dispositions réglementaires générales ; sa durée est illimitée.

Article 2. L'ATP a pour objectifs :

  • Assurer la promotion et le développement de la pédiatrie et de toutes les spécialités qui s'y rattachent.
  • Participer et s'engager aux actions de Formation Médicale Continue destinées aux pédiatres ainsi qu'aux autres médecins et personnels de santé ayant la charge de la santé de l'enfant.
  • Participer aux actions d'information des familles, des associations de malades et du public.
  • Engager des actions de nature à promouvoir la santé des enfants et des adolescents.
  • Constituer un pôle de référence et d'expertise pour les autorités sanitaires pour tous les problèmes de santé infantile.
  • Stimuler l'émergence des spécialités pédiatriques en Tunisie et promouvoir leur développement.
  • Représenter la pédiatrie tunisienne auprès des différents partenaires et des instances nationales, régionales et internationales.
  • Stimuler la recherche biomédicale en pédiatrie clinique et préventive, en milieu hospitalier comme en pédiatrie ambulatoire.

Article 3. L'association se compose de membres d'honneur, de membres titulaires, de membres associés et de membres correspondants.

Article 4. Sont membres titulaires de droit tous les spécialistes en pédiatrie exerçant en pédiatrie en Tunisie.

Article 5. Sont membres associés : les médecins généralistes, les médecins spécialistes s'occupant d'enfants ainsi que les résidents en pédiatrie.

Article 6. Le titre de membre d'honneur peut être décerné par le bureau aux personnes qui rendent ou ont rendu des services signalés à l'association ou à la pédiatrie tunisienne. Les membres d'honneur sont dispensés de cotisation ; ils ne sont pas éligibles au bureau mais disposent du droit de vote en assemblée générale s'ils sont docteurs en médecine.

Article 7. Peuvent être membres correspondants les étrangers n'exerçant pas en Tunisie et entrant dans l'une des catégories prévues aux articles 5 et 6. Leur nomination a lieu sur proposition du bureau.

Article 8. Les membres titulaires et d'honneur ont voix délibérative. Ils peuvent faire partie des commissions et prendre part aux élections.

Article 9. La qualité de membre se perd par : démission adressée au président par lettre recommandée ; défaut de paiement répété des cotisations après rappel ; exclusion prononcée par le bureau après avoir accordé à l'intéressé un délai pour présenter ses explications.

Chapitre II — Administration et fonctionnement

Article 10. Le bureau de l'ATP est composé de 9 membres : le président, le vice-président, le secrétaire général, le secrétaire général adjoint, le trésorier, le trésorier adjoint et trois conseillers.

Article 11. Élections du bureau : être de nationalité tunisienne, membre titulaire depuis au moins trois ans et à jour de cotisations pour être éligible. Élections au bulletin secret à la majorité des membres titulaires présents en Assemblée Générale ; vote par procuration possible (une seule par membre, signée et légalisée). Mandat de trois ans ; membres rééligibles mais pas plus de deux mandats successifs au même poste ; le président ne peut cumuler plus de deux mandats successifs. Candidatures adressées au Secrétaire Général 15 jours avant les élections ; assemblée élective annoncée par voie de presse 30 jours à l'avance ; chaque membre avisé 30 jours à l'avance. Le procès-verbal de l'assemblée élective et la composition du bureau sont déposés auprès des autorités dans le mois et diffusés par voie de presse.

Article 12. Le procès-verbal de chaque réunion, rédigé par le secrétaire général ou son adjoint, est adressé aux membres du bureau dans les quinze jours, adopté à la réunion suivante, signé par le Président et le Secrétaire Général, et archivé dans un registre numéroté.

Article 13. Le bureau se réunit au moins une fois tous les deux mois, et en session extraordinaire à la demande des 2/3 de ses membres. La présence d'au moins 1/3 des membres est nécessaire pour valider les délibérations ; en cas de partage des voix, celle du Président est prépondérante.

Article 14. L'Assemblée Générale Ordinaire se tient au moins une fois par an au cours du congrès national (convocation 15 jours à l'avance avec ordre du jour). Elle entend les rapports de gestion et la situation financière et morale, approuve les comptes de l'exercice précédent et délibère sur les questions à l'ordre du jour ; décisions prises à la majorité relative. Une Assemblée Générale Extraordinaire peut être convoquée par le président ou à la demande du 1/3 des membres titulaires.

Article 15. L'association est représentée en justice et dans tous les actes de la vie civile par son président, son secrétaire général ou un membre mandaté du bureau.

Chapitre III — Trésorerie

Article 16. Les ressources se composent des cotisations des membres, de subventions et dons, des recettes des manifestations scientifiques et des intérêts provenant de ses biens.

Article 17. Les fonds sont destinés à couvrir les dépenses (loyer, personnel, frais généraux), l'information et la documentation, l'édition et la diffusion de la revue, et les activités scientifiques. L'excédent est mis en réserve et confié au trésorier.

Article 18. Les dépenses sont ordonnancées par le président (ou par délégation le secrétaire général) et payées par le trésorier, qui les porte sur un registre spécial numéroté conformément à la législation tunisienne.

Chapitre IV — Modification des statuts et dissolution

Article 19. Les statuts ne peuvent être modifiés que sur proposition du bureau ou sur demande écrite d'au moins 1/3 des membres titulaires, adressée au président au moins un mois avant la séance. L'assemblée doit réunir au moins les 2/3 des membres titulaires ; à défaut, elle est reconvoquée après au moins 15 jours et délibère alors quel que soit le nombre de présents. Les statuts ne sont modifiés qu'à la majorité relative des voix.

Article 20. L'assemblée générale extraordinaire se prononçant sur la dissolution doit comprendre au moins les 2/3 des membres titulaires ; à défaut, elle est reconvoquée après au moins 15 jours et délibère quel que soit le nombre de présents.

Article 21. En cas de dissolution, le devenir des biens est décidé par l'assemblée générale dans le respect de la réglementation (l'argent provenant des subventions de l'État est remis à l'État). Un ou plusieurs commissaires peuvent être désignés pour la liquidation des biens.

Chapitre V — Activités de l'association

Article 22. L'ATP organise : le congrès national annuel ; le congrès de l'Union des Sociétés Maghrébines de Pédiatrie en alternance avec les autres pays du Maghreb ; les congrès internationaux auxquels elle adhère ; des réunions scientifiques régionales ; des journées de formation médicale continue ; et l'édition de la Revue Maghrébine de Pédiatrie, organe officiel de l'association.

Article 23. L'ATP est représentée, sur décision du bureau, par son président (ou son vice-président ou un membre désigné) auprès de l'Association Internationale de Pédiatrie et des autres associations internationales ou régionales de mêmes intérêts.

Article 24. L'ATP encourage la constitution de groupes de travail sur des sur-spécialités pédiatriques ou tout autre problème de santé de l'enfant, sur demande faite au bureau. Chaque groupe est coordonné par un membre désigné d'un commun accord ; le coordinateur est nommé de droit consultant au bureau. Les manifestations d'un groupe sont placées sous l'égide de l'ATP ; le groupe prend fin à la fin du mandat, son renouvellement suivant la même procédure.

القانون الأساسي للجمعية التونسية لطب الأطفال

الباب الأول — التسمية والمقرّ والأهداف والتركيبة

الفصل 1. تأسّست الجمعية التونسية لطب الأطفال (STP) سنة 1960 طبقا لأحكام القانون عدد 154 لسنة 1959 المؤرّخ في 07/11/1959، كما تمّ تنقيحه بالقانون الأساسي عدد 90 لسنة 1988 المؤرّخ في 02/08/1988 وبالقانون عدد 25 لسنة 1992 المؤرّخ في 02/04/1992. وأصبحت الجمعية التونسية لطب الأطفال (ATP) في 8 سبتمبر 1998 طبقا للقانون الجديد المتعلّق بالجمعيات. ويقع مقرّها بمستشفى بشير حمزة بتونس. وهي جمعية علمية تخضع للأحكام الترتيبية العامة، ومدّتها غير محدودة.

الفصل 2. تهدف الجمعية إلى:

  • ضمان النهوض بطب الأطفال وتطويره وكلّ الاختصاصات المتّصلة به.
  • المشاركة والانخراط في أعمال التكوين الطبي المستمرّ الموجّهة لأطباء الأطفال وسائر الأطباء وأعوان الصحّة المكلّفين بصحّة الطفل.
  • المشاركة في أعمال إعلام العائلات وجمعيات المرضى والعموم.
  • القيام بأعمال كفيلة بالنهوض بصحّة الأطفال والمراهقين.
  • تشكيل قطب مرجعية وخبرة لفائدة السلطات الصحية في كلّ مشاكل صحّة الطفل.
  • حفز بروز اختصاصات طب الأطفال في تونس والنهوض بتطويرها.
  • تمثيل طب الأطفال التونسي لدى مختلف الشركاء والهيئات الوطنية والجهوية والدولية.
  • حفز البحث الطبّي الحيوي في طب الأطفال السريري والوقائي، في الوسط الاستشفائي وفي طب الأطفال الخارجي.

الفصل 3. تتكوّن الجمعية من أعضاء شرف وأعضاء مباشرين وأعضاء منتسبين وأعضاء مراسلين.

الفصل 4. يُعدّ أعضاء مباشرين بحكم القانون جميع المختصّين في طب الأطفال الممارسين لطب الأطفال في تونس.

الفصل 5. يُعدّ أعضاء منتسبين: الأطباء العامّون والأطباء المختصّون الذين يعتنون بالأطفال وكذلك المقيمون في طب الأطفال.

الفصل 6. يمكن للمكتب أن يُسند صفة عضو شرف للأشخاص الذين يُسدون أو أسدوا خدمات بارزة للجمعية أو لطب الأطفال التونسي. ويُعفى أعضاء الشرف من الاشتراك، ولا يحقّ لهم الترشّح للمكتب، غير أنّهم يتمتّعون بحقّ التصويت في الجلسة العامة إن كانوا دكاترة في الطبّ.

الفصل 7. يمكن أن يكون أعضاء مراسلين الأجانب الذين لا يمارسون في تونس والمنتمون إلى إحدى الفئات المنصوص عليها بالفصلين 5 و6. ويتمّ تعيينهم باقتراح من المكتب.

الفصل 8. للأعضاء المباشرين وأعضاء الشرف صوت تقريري. ويمكنهم عضوية اللجان والمشاركة في الانتخابات.

الفصل 9. تزول صفة العضو بـ: الاستقالة الموجّهة إلى الرئيس بمكتوب مضمون الوصول؛ والتخلّف المتكرّر عن خلاص الاشتراكات بعد التنبيه؛ والطرد الذي يقرّره المكتب بعد منح المعني بالأمر أجلا لتقديم توضيحاته.

الباب الثاني — الإدارة والتسيير

الفصل 10. يتكوّن مكتب الجمعية من 9 أعضاء: الرئيس، ونائب الرئيس، والكاتب العام، والكاتب العام المساعد، وأمين المال، وأمين المال المساعد، وثلاثة مستشارين.

الفصل 11. انتخابات المكتب: يُشترط في المترشّح أن يكون تونسي الجنسية، وعضوا مباشرا منذ ثلاث سنوات على الأقلّ، ومنتظما في خلاص اشتراكاته. تجري الانتخابات بالاقتراع السرّي بأغلبية الأعضاء المباشرين الحاضرين في الجلسة العامة؛ ويُقبل التصويت بالإنابة (إنابة واحدة لكلّ عضو، ممضاة ومعرّف بالإمضاء). ومدّة النيابة ثلاث سنوات؛ ويمكن إعادة انتخاب الأعضاء دون تجاوز نيابتين متتاليتين في نفس الخطّة؛ ولا يمكن للرئيس أن يجمع أكثر من نيابتين متتاليتين. وتُوجَّه الترشّحات إلى الكاتب العام قبل 15 يوما من الانتخابات؛ ويُعلَن عن الجلسة الانتخابية بواسطة الصحافة قبل 30 يوما؛ ويُعلَم كلّ عضو قبل 30 يوما. ويُودَع محضر الجلسة الانتخابية وتركيبة المكتب لدى السلطات في ظرف شهر ويُنشران بواسطة الصحافة.

الفصل 12. يُحرّر الكاتب العام أو مساعده محضر كلّ جلسة، ويُوجَّه إلى أعضاء المكتب في ظرف خمسة عشر يوما، ويُصادَق عليه في الجلسة الموالية، ويُمضيه الرئيس والكاتب العام، ويُحفَظ في سجلّ مرقّم.

الفصل 13. يجتمع المكتب مرّة كلّ شهرين على الأقلّ، وفي دورة استثنائية بطلب من ثلثي أعضائه. ويُشترط حضور ثلث الأعضاء على الأقلّ لصحّة المداولات؛ وعند تساوي الأصوات يكون صوت الرئيس مرجّحا.

الفصل 14. تنعقد الجلسة العامة العادية مرّة في السنة على الأقلّ خلال المؤتمر الوطني (بالدعوة قبل 15 يوما مع جدول الأعمال). وتستمع إلى تقارير التصرّف والوضعية المالية والأدبية، وتصادق على حسابات السنة المنقضية، وتتداول في المسائل المدرجة بجدول الأعمال؛ وتُتّخذ القرارات بالأغلبية النسبية. ويمكن عقد جلسة عامة استثنائية بدعوة من الرئيس أو بطلب من ثلث الأعضاء المباشرين.

الفصل 15. يمثّل الجمعيةَ لدى القضاء وفي جميع أعمال الحياة المدنية رئيسُها أو كاتبها العام أو عضو مفوّض من المكتب.

الباب الثالث — المالية

الفصل 16. تتكوّن موارد الجمعية من اشتراكات الأعضاء، والمنح والهبات، ومداخيل التظاهرات العلمية، والفوائد المتأتّية من ممتلكاتها.

الفصل 17. تُخصَّص الأموال لتغطية المصاريف (الكراء، الأعوان، المصاريف العامة)، والإعلام والتوثيق، وإصدار المجلّة وتوزيعها، والأنشطة العلمية. ويُوضَع الفائض في احتياطي يُعهَد به إلى أمين المال.

الفصل 18. يأذن الرئيس بالمصاريف (أو الكاتب العام بالتفويض) ويصرفها أمين المال، الذي يُدوّنها في سجلّ خاصّ مرقّم طبقا للتشريع التونسي.

الباب الرابع — تنقيح القانون الأساسي والحلّ

الفصل 19. لا يمكن تنقيح القانون الأساسي إلّا باقتراح من المكتب أو بطلب كتابي من ثلث الأعضاء المباشرين على الأقلّ، يُوجَّه إلى الرئيس قبل شهر على الأقلّ من الجلسة. ويجب أن تضمّ الجلسة ثلثي الأعضاء المباشرين على الأقلّ؛ وإلّا تُعاد الدعوة إليها بعد 15 يوما على الأقلّ وتتداول حينئذ مهما كان عدد الحاضرين. ولا يُنقَّح القانون الأساسي إلّا بالأغلبية النسبية للأصوات.

الفصل 20. يجب أن تضمّ الجلسة العامة الاستثنائية التي تبتّ في الحلّ ثلثي الأعضاء المباشرين على الأقلّ؛ وإلّا تُعاد الدعوة إليها بعد 15 يوما على الأقلّ وتتداول مهما كان عدد الحاضرين.

الفصل 21. في صورة الحلّ، تقرّر الجلسة العامة مآل الممتلكات في احترام للتراتيب (تُرجَع الأموال المتأتّية من منح الدولة إلى الدولة). ويمكن تعيين مصفٍّ أو أكثر لتصفية الممتلكات.

الباب الخامس — أنشطة الجمعية

الفصل 22. تنظّم الجمعية: المؤتمر الوطني السنوي؛ ومؤتمر اتّحاد الجمعيات المغاربية لطب الأطفال بالتناوب مع بقية بلدان المغرب؛ والمؤتمرات الدولية التي تنخرط فيها؛ واجتماعات علمية جهوية؛ وأيام تكوين طبّي مستمرّ؛ وإصدار المجلّة المغاربية لطب الأطفال، الجهاز الرسمي للجمعية.

الفصل 23. تُمثَّل الجمعية، بقرار من المكتب، برئيسها (أو نائب رئيسها أو عضو معيّن) لدى الجمعية الدولية لطب الأطفال وسائر الجمعيات الدولية أو الجهوية ذات الاهتمامات المشتركة.

الفصل 24. تشجّع الجمعية على تكوين مجموعات عمل حول الاختصاصات الدقيقة لطب الأطفال أو أيّ مشكل آخر يتعلّق بصحّة الطفل، بطلب يُقدَّم إلى المكتب. ويُنسّق كلّ مجموعة عضو يُعيَّن بالاتّفاق؛ ويُصبح المنسّق مستشارا بحكم القانون لدى المكتب. وتُوضَع تظاهرات المجموعة تحت رعاية الجمعية؛ وتنتهي المجموعة بانتهاء النيابة، ويتمّ تجديدها وفق نفس الإجراء.

Statutes of the Tunisian Association of Paediatrics

Chapter I — Name, headquarters, objectives, composition

Article 1. The Tunisian Society of Paediatrics (STP) was founded in 1960 in accordance with the provisions of Law 154/1959 of 07/11/1959, as amended by Organic Law No. 90/1988 of 02/08/1988 and by Law No. 25/1992 of 02/04/1992. It became the Tunisian Association of Paediatrics (ATP) on 8 September 1998, in accordance with the new law on associations. Its headquarters are at the Béchir Hamza Hospital in Tunis. It is a scientific association governed by the general regulatory provisions; its duration is unlimited.

Article 2. The ATP's objectives are:

  • To ensure the promotion and development of paediatrics and all related specialties.
  • To take part and engage in Continuing Medical Education actions aimed at paediatricians as well as other physicians and health staff responsible for child health.
  • To take part in informing families, patient associations and the public.
  • To undertake actions to promote the health of children and adolescents.
  • To constitute a centre of reference and expertise for the health authorities on all matters of child health.
  • To stimulate the emergence of paediatric specialties in Tunisia and promote their development.
  • To represent Tunisian paediatrics before the various partners and national, regional and international bodies.
  • To stimulate biomedical research in clinical and preventive paediatrics, in both hospital and ambulatory settings.

Article 3. The association is composed of honorary members, full members, associate members and corresponding members.

Article 4. All paediatric specialists practising paediatrics in Tunisia are full members by right.

Article 5. Associate members are: general practitioners, specialist physicians who care for children, and residents in paediatrics.

Article 6. The title of honorary member may be awarded by the board to persons who render or have rendered notable services to the association or to Tunisian paediatrics. Honorary members are exempt from the membership fee; they are not eligible for the board but have the right to vote at the general assembly if they are doctors of medicine.

Article 7. Foreign nationals who do not practise in Tunisia and who fall into one of the categories provided for in articles 5 and 6 may be corresponding members. Their appointment is made on the proposal of the board.

Article 8. Full and honorary members have a deliberative vote. They may serve on committees and take part in elections.

Article 9. Membership is lost through: resignation addressed to the president by registered letter; repeated failure to pay membership fees after reminder; expulsion pronounced by the board after granting the person concerned a period to present their explanations.

Chapter II — Administration and operation

Article 10. The ATP board is composed of 9 members: the president, the vice-president, the secretary general, the deputy secretary general, the treasurer, the deputy treasurer and three advisors.

Article 11. Board elections: to be eligible, a candidate must be of Tunisian nationality, a full member for at least three years and up to date with membership fees. Elections are by secret ballot by a majority of the full members present at the General Assembly; voting by proxy is allowed (one proxy per member, signed and legally certified). The term is three years; members may be re-elected but for no more than two consecutive terms in the same position; the president may not hold more than two consecutive terms. Applications are addressed to the Secretary General 15 days before the elections; the elective assembly is announced through the press 30 days in advance; each member is notified 30 days in advance. The minutes of the elective assembly and the composition of the board are filed with the authorities within one month and published through the press.

Article 12. The minutes of each meeting, drawn up by the secretary general or their deputy, are sent to the board members within fifteen days, adopted at the following meeting, signed by the President and the Secretary General, and archived in a numbered register.

Article 13. The board meets at least once every two months, and in extraordinary session at the request of 2/3 of its members. The presence of at least 1/3 of the members is required to validate the deliberations; in the event of a tie, the President's vote is decisive.

Article 14. The Ordinary General Assembly is held at least once a year during the national congress (with 15 days' notice and an agenda). It hears the management reports and the financial and moral situation, approves the accounts of the previous year and deliberates on the matters on the agenda; decisions are taken by relative majority. An Extraordinary General Assembly may be convened by the president or at the request of 1/3 of the full members.

Article 15. The association is represented in court and in all acts of civil life by its president, its secretary general or a mandated board member.

Chapter III — Finances

Article 16. The resources consist of members' fees, subsidies and donations, income from scientific events and interest from its assets.

Article 17. The funds are intended to cover expenses (rent, staff, overheads), information and documentation, the publication and distribution of the journal, and scientific activities. The surplus is placed in reserve and entrusted to the treasurer.

Article 18. Expenses are authorised by the president (or, by delegation, the secretary general) and paid by the treasurer, who records them in a special numbered register in accordance with Tunisian legislation.

Chapter IV — Amendment of the statutes and dissolution

Article 19. The statutes may only be amended on the proposal of the board or on the written request of at least 1/3 of the full members, addressed to the president at least one month before the session. The assembly must bring together at least 2/3 of the full members; failing this, it is reconvened after at least 15 days and then deliberates regardless of the number present. The statutes are amended only by relative majority of votes.

Article 20. The extraordinary general assembly deciding on dissolution must comprise at least 2/3 of the full members; failing this, it is reconvened after at least 15 days and deliberates regardless of the number present.

Article 21. In the event of dissolution, the fate of the assets is decided by the general assembly in compliance with the regulations (money from State subsidies is returned to the State). One or more liquidators may be appointed to liquidate the assets.

Chapter V — Activities of the association

Article 22. The ATP organises: the annual national congress; the congress of the Union of Maghreb Societies of Paediatrics, alternating with the other Maghreb countries; the international congresses it belongs to; regional scientific meetings; continuing medical education days; and the publication of the Maghreb Journal of Paediatrics, the official organ of the association.

Article 23. The ATP is represented, by decision of the board, by its president (or its vice-president or a designated member) before the International Paediatric Association and other international or regional associations with the same interests.

Article 24. The ATP encourages the formation of working groups on paediatric sub-specialties or any other child-health issue, upon request made to the board. Each group is coordinated by a member designated by mutual agreement; the coordinator is by right appointed as a consultant to the board. The group's events are placed under the aegis of the ATP; the group ends at the end of the term, its renewal following the same procedure.
